1. Introduction

These Terms and Conditions govern the use of this website and the services provided by Bloomhood Solutions Limited. They are designed to clearly define the rights, responsibilities, and obligations of both our clients and Bloomhood Solutions Limited in the delivery of services. 2. Scope of Services

Bloomhood Solutions Limited provides strata corporation, homeowners’ association (HOA), and gated community management services, including services delivered to gated communities operated through limited liability companies, as well as administrative, financial, and operational support as agreed under a separate management agreement.

Our services do not include real estate sales, leasing, valuation, or brokerage activities.

3. Authority and Decision-Making

Bloomhood Solutions Limited acts in an administrative and management capacity only. All strategic, financial, operational, and enforcement decisions remain the responsibility of the relevant board, committee, directors, or ownership body, including those of strata corporations, homeowners’ associations, and gated communities operated through limited liability companies. Bloomhood Solutions Limited shall not be responsible for decisions made, actions taken, or instructions given by the board, committee, directors, owners, or residents.

4. Regulatory Status

Bloomhood Solutions Limited is not engaged in real estate brokerage activities and is therefore not licensed or regulated by the Real Estate Board of Jamaica (REB). Our services fall outside the scope of REB regulation.

5. Client Responsibilities

Clients are responsible for:

Providing accurate and complete information
Making timely decisions where required
Ensuring compliance with applicable laws, by-laws, and governing documents
Paying agreed fees and expenses when due

Failure to meet these responsibilities may affect service delivery.

6. Fees and Payments

Fees are charged in accordance with the applicable management agreement. All fees are exclusive of statutory taxes unless otherwise stated. Late or unpaid amounts may result in suspension of services.

7. Third-Party Service Providers

Where required, Bloomhood Solutions Limited may engage third-party contractors or service providers on behalf of the client. While reasonable care is taken in selection, we are not responsible for the acts, omissions, or performance of third parties.

8. Limitation of Liability

To the fullest extent permitted by law, Bloomhood Solutions Limited shall not be liable for:

Indirect, incidental, or consequential losses
Losses arising from decisions made by boards, owners, or residents
Matters outside our reasonable control

Our liability, where applicable, is limited to the fees paid for the relevant services.

9. No Legal or Financial Advice

Information provided through this website or during service delivery is general in nature and does not constitute legal, accounting, or financial advice. Clients should seek independent professional advice where required.

10. Confidentiality

We treat client information as confidential and will not disclose it except where required by law or authorised by the client.

12. Termination

Either party may terminate services in accordance with the terms set out in the applicable management agreement.

13. Governing Law
